Ein Bericht:
Mehr als ein halbes Jahrhundert hat es gedauert, bis die Fraktionen des Deutschen Bundestages im Dezember 2000 einstimmig anerkannten, dass auch Homosexuelle Opfer der Nationalsozialisten waren. Zehn Jahre dachte die Bundesregierung über eine kollektive Entschädigung nach.

„Gedenken muss auch Konsequenzen haben. Nach Nazi-Strafrecht verfolgte Homosexuelle müssen wir endlich rehabilitieren und entschädigen“, sagt Günter Dworek, Bundesvorstand des Lesben- und Schwulenverbandes (LSVD), anlässlich des Gedenktages für die Opfer des Nationalsozialismus 2010. Eine deutliche politische Geste der deutschen Regierung fehlt bis heute. Allerdings stellte der Haushaltsausschuss des Deutschen Bundestages Ende letzten Jahres – endlich – die Mittel zur Gründung einer Stiftung bereit. Über diese Art symbolischer Wiedergutmachung aus Bundesgeldern, hatten regierende Politiker lange nachgedacht. Zweimal scheiterte das Gesetzesvorhaben nach hitzigen Debatten im Bundestag: 2002 stimmten Union und FDP dagegen und zwei Jahre später brachten SPD und Grüne den erneuten Vorstoß zu Fall. Für die Überlebenden von damals ist es heute zu spät. Fast alle sind gestorben. Die schwarz-gelbe Bundesregierung startete einen nächsten Versuch und nahm die Stiftungsgründung erneut in den Koalitionsvertrag auf. Zum dritten Mal.
Beschlossen wurde jetzt ein Forschungsinstitut, das sich mit Homosexualität und der Diskriminierung Homosexueller in aller Welt auseinandersetzt. 2003 wurde folgender Gesetzestext formuliert:
„Zweck der Stiftung soll es sein, homosexuelles Leben im Gebiet der Bundesrepublik Deutschland wissenschaftlich zu erforschen und darzustellen, die nationalsozialistische Verfolgung Homosexueller in Erinnerung zu halten, durch Öffentlichkeitsarbeit einer gesellschaftlichen Diskriminierung homosexueller Männer und Frauen in Deutschland entgegenzuwirken, Bürgerrechtsarbeit zu fördern, Menschenrechtsarbeit im Ausland zu unterstützen sowie das Gedenken an Leben und Werk Magnus Hirschfelds zu pflegen.“
Damit soll die Stiftung an die Arbeit von Magnus Hirschfeld anknüpfen und seinen Namen tragen. Hirschfeld, der Pionier der ersten Homosexuellenbewegung, gründete 1919 das Institut für Sexualwissenschaft – die weltweit erste Forschungseinrichtung dieser Art. Hirschfeld war den Nazis verhasst: weil er Jude war, weil er, wie der bayrische Schriftsteller Ludwig Thoma es formulierte, „die Freigabe der Sodomie wie eine Sache des Volkswohles“ betrieb, und weil er homosexuell war. Die Nazis zerstörten und plünderten sein Institut 1933 – wenige Tage vor der Bücherverbrennung. „Sexualwissenschaft und Sexualreform waren für Hirschfeld untrennbar miteinander verknüpft“, sagt Martin Dannecker, Vorsitzender des Instituts für Sexualwissenschaft Deutschland, „durchdrungen von der Überzeugung, dass Wissen zur Vernunft führt, rückte er mit einem unbändigen Willen zum Wissen der Sexualität, nicht nur jener der Homosexuellen zu Leibe. Er erforschte sie mit empirischen Mitteln, was damals neu war und zu Einsichten führte, die nicht vom klinischen Blick zugerichtet waren.“
Hirschfeld, der schon mehrfach von Nazis angegriffen und 1921 bei einem Attentat schwer verletzt wurde, hatte sich bereits 1930 entschlossen, nach einer angetretenen Vortragsreise nicht mehr nach Deutschland zurückzukehren. 1935 starb er an seinem 67. Geburtstag im Exil in Nizza.
Homosexuelle als “Perverse” und “Abartige” stigmatisiert
Die Verfolgung Homosexueller war keine spezifisch nationalsozialistische Erscheinung, aber sie nahm im Nationalsozialismus spezifische Züge an. Strafrechtlich verfolgt wurden homosexuelle Männer lange vor 1933. Ihre Kriminalisierung reicht bis ins frühe Mittelalter zurück. In Deutschland existierte seit 1871 der Paragraph 175, der die „widernatürliche Unzucht“ unter Männern unter Strafe stellte. Trotzdem konnten sich Homosexuelle in der Weimarer Republik in Großstädten Freiräume erkämpfen und Homosexualität bekam einen fast selbstverständlichen, unspektakulären Charakter. Viele wähnten sich noch nach der Machtübernahme Hitlers in Sicherheit, da sie Ernst Röhm, Stabschef der SA, an Hitlers Seite sahen, von dem jeder wusste, dass er homosexuell war. 1933 aber begann eine Politik, die in Ansätzen bereits vorzeichnete, was in den nächsten Jahren schärfer an Kontur gewinnen sollte: Willkürmaßnahmen zur Abschreckung, Terror zur Ausrottung, Zwangsmaßnahmen zur Heilung der „Seuche“ Homosexualität. Lokale und Szene-Treffpunkte von Homosexuellen mussten schließen, Schwulen-Zeitschriften wurden verboten. Homosexuelle wurden von den Nazis als „Perverse“ und „Abartige“ stigmatisiert und öffentlich diskriminiert.
1934 wurde Ernst Röhm, in der „Nacht der langen Messer“, auf Befehl Hitlers ermordet; angeblich wegen eines bevorstehenden Putschversuches. Nur wenige Monate später folgte die Verschärfung der strafrechtlichen Bestimmungen und ein offener Kampf gegen Schwule begann. Mit der Neufassung des Paragraphen 175 war das „Vorliegen einer beischlafähnlichen Handlung“ nicht mehr erforderlich. Damit entfiel auch die Notwendigkeit, ein strafbares Verhalten nachweisen zu müssen, und die gesetzliche Einstellung eines Verfahrens wurde auf diese Weise unmöglich gemacht.
Ranghohe Nazis forderten im Zuge der Verschärfung des Paragraphen 175 eine Ausdehnung der Strafbarkeit auf Frauen. Doch sie konnten sich nicht durchsetzen und weibliche Homosexualität blieb damit offiziell straffrei. Die Historikerin Claudia Schoppmann, die maßgebliche Autorität auf dem Gebiet der lesbischen Lebenswelten unter Hitler, sagt, „dass es keine systematische Verfolgung lesbischer Frauen gegeben hat, die mit derjenigen homosexueller Männer vergleichbar ist.“ Das verhinderte allein schon das sexistische Frauenbild der Nationalsozialisten. Eine Strafverfolgung weiblicher Homosexualität hätte die Aufwertung von Frauen im Allgemeinen und ihrer Sexualität im Besonderen bedeutet. Das konnte nicht im Sinne des „Männerstaates“ sein.“
Von homosexuellen Männern sind Dokumente und Akten über Lebens- und Leidenswege nur spärlich vorhanden. Historiker gehen aber von folgenden Zahlen aus: 50000 Männer mussten während des Dritten Reiches wegen gleichgeschlechtlicher Kontakte vor Gericht. Bis zu 15000 Männer wurden in Konzentrationslager gebracht. In einigen Fällen wurden Homosexuelle zwangssterilisiert oder sie wurden als medizinische Versuchsobjekte missbraucht. Belegt sind zahlreiche Experimente zur „hormonellen Umpolung“ und Fleckfieberversuche im Konzentrationslager Buchenwald.
Für die Nationalsozialisten bedeutete Homosexualität nicht nur eine Krankheit, sondern auch einen elementaren Verstoß gegen das „rassische“ Lebensgesetz, das die Stärke eines Volkes an der Zahl seiner Geburten misst. Auch die Angst vor Ansteckung war groß. Hitler selbst sagte in diesem Zusammenhang: „ihre ansteckende Wirkung erstreckt sich mit Sicherheit eines Naturgesetzes auf die besten und männlichsten Charaktere, wenn sie einmal grassiert.“ Im Oktober 1936 errichtete Himmler die „Reichszentrale zur Bekämpfung der Homosexualität und Abtreibung“. Damit war das Hauptinstrument zur Homosexuellen-Verfolgung geschaffen. Durch einen Erlass von 1940 verschärfte Himmler die Situation für Homosexuelle weiter. Er ordnete an, dass alle Homosexuellen, die mehr als einen Partner „verführt“ hatten, im Anschluss an die Gefängnisstrafe in Vorbeugehaft zu nehmen waren. Bei dem technischen Begriff Vorbeugehaft handelte es sich um nichts anderes als um die Überweisung in ein Konzentrationslager.
Häftlinge mit dem “rosa Winkel”
In Konzentrationslagern stellten homosexuelle Häftlinge – kenntlich gemacht durch einen aufgenähten rosa Winkel – nur eine winzige Minderheit dar, weniger als ein Prozent. Über Schicksale der einzelnen Lagerinsassen sagen solche Quantitäten freilich wenig aus. Die Behandlung der Strafgefangenen durch das Wachpersonal war brutal. Sie wurden geschlagen, getreten, schikaniert und sexuell gedemütigt. Heinz Heger schreibt in einem Bericht über seine Haft im Konzentrationslager Sachsenhausen: „Es war Januar und einige Grade unter null, dazu fegte ein eisiger Wind durch die Lagerstraße, aber man ließ uns nackt und barfuß auf dem verschneiten Boden stehen und warten. Ein SS-Scharführer im Wintermantel mit Pelzkragen ging durch unsere Reihen und schlug einmal diesem, einmal jenem mit einem Ochsenziemer kräftig über Kopf und Rücken, wobei er öfters schrie: ‚Dass ihr mir nicht einfriert, ihr schwulen Säcke!‘“ Die Chancen, in den Konzentrationslagern zu überleben, waren extrem gering. Da das Verhalten der jeweiligen Lagerleitung durch Willkür geprägt war, bestand für den einzelnen Häftling kaum die Möglichkeit, eine Strategie des Überlebens zu entwickeln. Die Solidarisierung mit anderen Gefangenen war ebenfalls nur schwer möglich, da Homosexuelle, wie auch Juden und sogenannte Asoziale, auf der niedrigsten Stufe der Lagerhierarchie standen.
Eine große Bedrohung ging in den Lagern von den Strafkompanien aus. So berichtete ein Zeitzeuge aus dem Konzentrationslager Sachsenhausen, dass viele Homosexuelle in dem KZ-Außenlager Klinkerwerk arbeiten mussten. In die „Knochenmühle“, wie das Klinkerwerk genannt wurde, kamen vor allem Häftlinge mit dem Vermerk „R.u.“, das hieß: Rückkehr unerwünscht. Weiter sagte der Zeitzeuge: „Die Arbeit der Häftlinge sah folgendermaßen aus: Jeweils drei mussten eine vollbeladene Lore im Laufschritt schieben, während SS-Leute und Vorarbeiter dabei auf die Gefangenen einschlugen; trat dadurch einer von ihnen neben die Postenkette, wurde sofort auf ihn geschossen.“ Tausende Homosexuelle wurden in Konzentrationslagern durch Zwangsarbeit hingerichtet. Nur wenige überlebten.
Verfolgung Homosexueller nach 1945
Mit der Befreiung durch die Alliierten hofften die Homosexuellen, dass nun auch ihre Befreiung stattfinden würde. Aber das Nazi-Strafrecht gegen Homosexuelle bestand in der Bundesrepublik noch jahrzehntelang fort und die Verfolgung durch Polizei und Justiz ging ungebrochen weiter. 1951 führte der Bundesgerichtshof aus: „Gegen die Fortgeltung des Paragraphen 175 in der Fassung vom 28.06.1935 […] bestehen keine Bedenken.“ Sechs Jahre später entschied auch das Bundesverfassungsgericht, dass der Paragraph 175 „nicht als nationalsozialistisches Unrecht zu betrachten sei“. 50.000 erwachsene Männern – noch einmal so viele wie unter Hitler – wurden in einem demokratischen Staat nach Nazi-Recht verurteilt. Erst 1969 wurde der Paragraph 175 reformiert und fiel 1994 als Folge der deutschen Einheit endgültig. Seitdem gilt für Heterosexuelle und Homosexuelle gleiches Strafrecht.
Als symbolische Wiedergutmachung war die Idee der Stiftung wiederauferstanden und im Koalitionsvertrag hieß es dazu: „Wir werden den Beschluss des Bundestages aus dem Jahr 2000 umsetzen und im Sinne eines kollektiven Ausgleichs für homosexuelle NS-Opfer eine Magnus-Hirschfeld-Stiftung errichten. Sie soll durch interdisziplinäre Forschung und Bildung der Diskriminierung homosexueller Männer und Frauen entgegenwirken.”
Zehn bis fünfzehn Millionen Euro Stiftungskapital stehen seit diesem Jahr bereit. Noch hat die Magnus-Hirschfeld-Stiftung keine Aufgaben übernommen. Man darf gespannt sein, welche Ziele sie verfolgen wird, wofür sie sich einsetzen wird und ob sie den Erwartungen gerecht werden kann.
